Terms Of Service

1. Parties

1.1. Service Provider:

1.2. Subscriber (Customer):

• Name / Company Name: The name or trade name declared by the user in the registration form.
• Address: The address declared by the user in the registration form.
• Email: The email declared by the user in the registration form.
• Phone: The phone number declared by the user in the registration form.

The Parties shall hereinafter be referred to collectively as "Parties" and individually as "Party".

2. Subject

The subject of this agreement is to determine the conditions for the Subscriber to benefit from the AI-powered media planning and analysis tool service.

3. Subscription Period and Renewal

• 3.1. The subscription is initiated by the Subscriber making the first payment.
• 3.2. The subscription is automatically renewed monthly until cancelled.
• 3.3. The service fee valid for the renewal period is charged from the Subscriber's payment method.
• 3.4. The Subscriber may cancel their subscription at any time via [website / customer panel / email].

4. Service Fee and Payment

• 4.1. The monthly fee for the service is subject to the package content selected by the subscriber at the time of purchase.
• 4.2. Payments are received via [credit card / debit card] method.
• 4.3. Service fees may be updated periodically; changes will be notified to the Subscriber at least 7 days in advance.

5. Termination and Cancellation

• 5.1. The Subscriber may cancel their subscription at any time; cancellation takes effect at the end of the current period.
• 5.2. The Service Provider has the right to suspend or terminate the subscription in case of breach of obligations by the Subscriber or misuse.

6. Protection of Personal Data

• 6.1. Mix Marketing Ai Bilişim Yazılım Limited processes personal data belonging to the Subscriber only for the purpose of fulfilling the contract within the scope of the Personal Data Protection Law No. 6698 (KVKK).
• 6.2. If personal data needs to be transferred abroad, the transfer is made based on the legal ground of "standard contract" pursuant to Article 9 of KVKK.
• 6.3. The Subscriber may exercise their rights under KVKK through the procedures specified at kvkk.gov.tr.
• 6.4. Ownership of all performance data uploaded to the system or retrieved via API by the Subscriber belongs to the Subscriber. The Service Provider acts as a "Data Processor" with respect to this data.

7. Use of Service

• 7.1. The Subscriber may use the service only for personal or commercial purposes specified in the contract.
• 7.2. Unauthorized sharing, reproduction, or transfer of the service to third parties is prohibited.
• 7.3. The Subscriber acknowledges that they grant the Service Provider access authorization to Meta Ads and Google Ads accounts via API. The use of these integrations is subject to the terms of use and privacy of the relevant Third Party Platforms.

8. Responsibilities

• 8.1. Mix Marketing Ai Bilişim Yazılım Limited cannot be held responsible for temporary interruptions due to technical problems.
• 8.2. The Subscriber agrees to use the service in accordance with laws and general moral rules.

9. Effectiveness and Resolution of Disputes

• 9.1. This agreement comes into force upon the Subscriber's approval and first payment.
• 9.2. BURSA Courts and Enforcement Offices are authorized for disputes that may arise between the Parties.
